In the 40 years of our Loyola summer law program in Rome, art law has emerged as a field of scholarly interest and professional practice. Art law is dynamic and wide ranging. It encompasses virtually all areas of the law, including property, contracts, criminal law, bankruptcy, civil procedure, trusts and estates, intellectual property, international law, tax, and more. Many art law cases come into existence because a particular work of art is in dispute. Those disputes can involve questions of ownership, authenticity, or value. The disputes can be between individuals, entities, or governments, and all combinations thereof.
This two-hour CLE program will explore art law from a transactional perspective of collectors from the acquisition, ownership, and disposition of art. Italian art has played a notable role in the development of U.S. art law. Highlights of Italian art and law that we will discuss include the Sistine Chapel contract from 1481; the 1960s’ loans to the U.S. of DaVinci’s Mona Lisa and Michelangelo’s Pieta; the 1991 smuggling from Italy of the Golden Phiale to its court-ordered return in 2000; Botticelli’s Madonna and Child (1485) seven-year odyssey through the Salander-O’Reilly Galleries bankruptcy (2007-2014); and Dmitry Rybolovlev’s current lawsuit against Sotheby’s over Salvator Mundi attributed to DaVinci.
